On 5 October 2021, Hong Kong, Malaysia, and a few other jurisdictions have been
placed on the Grey List of Non-Cooperative Tax Jurisdictions (“Grey List”) by the
European Union (“EU”).
This is due to the EU’s concerns of double non-taxation of foreign-sourced passive
income, such as interest and royalties, under Hong Kong and Malaysian territorial
source systems.
What does this Grey List exactly mean for businesses in Hong Kong and Malaysia?
And, what has been the Government response in those jurisdictions till so far?
But also, why has Singapore not been put on the Grey List despite having a territorial
regime like Hong Kong and Malaysia? What is the EU's standpoint about the Asian
territorial tax systems?
The IFA Hong Kong Branch together with the IFA Malaysian and Singaporean
Branches will address these questions and provide answers to any other questions
that arise during this program.
